Divorce

Divorce Attorney in Wareham, MA

Divorce (or marital dissolution) is typically a painful and complex process. Issues surrounding the divorce, including child custody and support, can bring out anger and frustration in people. This is why it's important to have a divorce attorney who has the experience and knowledge to successfully guide you through the process.

Some of the questions you may have when you are considering a divorce:

What are the grounds for a divorce in Massachusetts?

Massachusetts permits both "fault-based" and "no-fault" divorces.

Fault-based divorce - When one party is blamed for the breakdown of the marriage. Grounds for fault-based divorce include cruel and abusive treatment, desertion continued for one year, refusal or neglect to provide suitable support and maintenance of the other spouse, and adultery.

No-fault divorce – When neither spouse is blamed for the breakdown of the marriage. No-fault divorce is awarded on grounds of "irretrievable breakdown" of the marriage.

How is marital property divided?

In Massachusetts, assets and debts acquired during your marriage are divided "equitably" when you divorce. Courts look at many factors in deciding what is equitable, including:

  • Marriage length
  • Conduct during the marriage
  • Age
  • Health
  • Occupation
  • Employability
  • Liabilities and needs of each party

If you and your spouse cannot reach an equitable settlement agreement, dividing your homes, vehicles, retirement funds and credit card debt, the matter will go before the Massachusetts Probate and Family Court.
